LabTechify Terms of Service

Welcome to LabTechify! These Terms of Service ("Terms") govern your access to and use of LabTechify's online training program ("Service"). Please read these Terms carefully before accessing or using the Service.

1. Acceptance of Terms

By accessing or using the Service, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms or the Privacy Policy, you may not access or use the Service.

2. Access to the Service

2.1 Eligibility: You must be at least 18 years old to access or use the Service. By accessing or using the Service, you represent and warrant that you are at least 18 years old.

2.2 Registration: In order to access certain features of the Service, you may be required to register for an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.

3.1 License: Subject to your compliance with these Terms, LabTechify grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your personal, non-commercial use.

(a) modify, adapt, translate, or reverse engineer any portion of the Service; (b) use the Service for any illegal or unauthorized purpose; (c) interfere with or disrupt the Service or servers or networks connected to the Service; (d) attempt to gain unauthorized access to the Service or any other user's account; (e) use any automated means, including bots, scripts, or spiders, to access or interact with the Service; or (f) use the Service in any manner that could damage, disable, overburden, or impair the Service.

4. Content

4.1 Ownership: LabTechify owns all rights, title, and interest in and to the Service and its content, including all intellectual property rights.

4.2 User Content: You retain ownership of any content you submit or upload to the Service ("User Content"). By submitting or uploading User Content, you grant LabTechify a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to use, reproduce, distribute, prepare derivative works of, display, and perform such User Content in connection with the Service.

5. Payment

5.1 Fees: Access to certain features of the Service may require payment of fees. By purchasing a subscription or making a payment, you agree to pay the applicable fees and any taxes or other charges imposed by applicable law.

5.2 Payment Methods: You may be required to provide a valid payment method to purchase a subscription or make a payment. You authorize LabTechify to charge the applicable fees to your payment method.

5.3 Once access to the program content has been granted, no refunds will be issued. LabTechify reserves the right to consider refund requests on a case-by-case basis, at its sole discretion.

6. Termination

6.1 Termination by LabTechify: LabTechify may terminate or suspend your access to the Service at any time for any reason or no reason, with or without notice.

6.2 Termination by You: You may terminate your account and these Terms by discontinuing your use of the Service.

7. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED. LABTECHIFY DISCLAIMS ALL WARRANTIES, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

8. Limitation of Liability

IN NO EVENT SHALL LABTECHIFY BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING, BUT NOT LIMITED TO, DAMAGES FOR LOSS OF PROFITS, REVENUE, DATA, OR USE, INCURRED BY YOU OR ANY THIRD PARTY, WHETHER IN AN ACTION IN CONTRACT, TORT, OR OTHERWISE, ARISING FROM YOUR ACCESS TO OR USE OF THE SERVICE.

9. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Utah, without regard to its conflict of law principles.

10. Changes to Terms

LabTechify reserves the right to modify or update these Terms at any time. Any changes to these Terms will be effective immediately upon posting. Your continued use of the Service after the posting of revised Terms constitutes your acceptance of the changes.
